MarMac Real Estate (“we,” “our,” “us”), operating through the Smart Broker Agent platform, respects the intellectual property rights of others and expects our users, agents, partners, and website visitors to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), it is our policy to respond to valid notices of alleged copyright infringement and to take appropriate actions under the DMCA and other applicable intellectual property laws.

 

1. Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been used or displayed on this website in a way that constitutes copyright infringement, please send a written DMCA Notice containing the following information:

 

Required Elements (per 17 U.S.C. § 512(c)(3))

A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.

Identification of the infringing material that you are requesting to have removed or disabled, including the specific URL(s) or description.

Your contact information, including: Full name Mailing address Phone number Email address

A statement that you have a good-faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.

A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner.

2. Counter-Notification (If You Believe Content Was Removed in Error)

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a written Counter-Notification containing:

Your physical or electronic signature.

Identification of the material that was removed or to which access was disabled, including the specific URL(s) where the material previously appeared.

A statement under penalty of perjury that you have a good-faith belief that the removal or disabling of the material was due to mistake or misidentification.

Your name, address, telephone number, and email address.

A statement that you consent to the jurisdiction of: the federal district court in the judicial district where you reside (if in the United States), or the Northern District of Alabama (if outside the United States).
And that you will accept service of process from the person who filed the original DMCA Notice.

Submit counter-notifications to the same DMCA Agent listed above.

 

3. Repeat Infringer Policy

MarMac Real Estate and Smart Broker Agent maintain a policy to:

Terminate access or accounts of users or agents who are determined to be repeat infringers.

Remove infringing materials promptly upon receipt of valid notices.

 

4. Misrepresentations

Under Section 512(f) of the DMCA, any person who knowingly misrepresents copyright infringement or misrepresents that removed material was lawful may be held liable for damages, including legal fees.

 

5. Modifications to This Policy

We reserve the right to modify or update this DMCA policy at any time. Changes will be posted with an updated revision date.
